Welcome to SELLFAST Classified Listing Platform

These Terms and Conditions (“Terms”) govern your access to and use of the Platform, including our website, mobile applications, messaging features, advertising services, and related services.

By accessing the Platform, creating an account, posting an advertisement, responding to an advertisement, or otherwise using the Platform, you agree to these Terms and our Privacy Policy and Prohibited Items and Content Policy, which form part of these Terms.

If you do not agree with these Terms, please do not use the Platform.

1. About the Platform

SELLFAST is an online classified-advertising marketplace that allows users to publish and discover advertisements for:

  • goods and products;
  • services;
  • employment opportunities and job vacancies;
  • properties and accommodation;
  • rentals of goods, equipment, vehicles, and other permitted items; and
  • other categories that we may make available from time to time.
  • Unless we expressly state otherwise, we are not the seller, buyer, employer, employee, landlord, tenant, agent, broker, or service provider in transactions between users.

The Platform primarily provides technology that allows users to advertise, communicate, and connect with one another.

2. Eligibility

You may use the Platform only if you are legally capable of entering into a binding agreement under applicable law.

If you are under the applicable legal age, you may use the Platform only where permitted by law and with the involvement or consent of a parent or legal guardian where required.

By using the Platform, you confirm that:

  • the information you provide is accurate and not misleading;
  • you have the authority to enter into these Terms;
  • you will comply with applicable laws and regulations;
  • you will not use another person’s identity or account without authorization; and
  • you will not use the Platform for fraudulent, unlawful, or abusive purposes.

We may request additional information or verification where reasonably necessary to protect users or comply with legal obligations.

3. Accounts

Certain Platform features may require you to create an account.

You are responsible for:

  • providing accurate registration information;
  • keeping your password and account credentials confidential;
  • maintaining the security of your account;
  • notifying us promptly if you suspect unauthorized access; and
  • all activity conducted through your account, except where applicable law provides otherwise.

You must not sell, rent, transfer, or otherwise allow another person to use your account without our permission.

We may suspend or restrict an account where we reasonably believe it has been compromised, misused, or used in violation of these Terms.

4. Posting Advertisements

When posting an advertisement, you agree that:

  • you have the legal right to advertise the item, property, service, job, or opportunity;
  • the information provided is accurate and complete to the best of your knowledge;
  • the advertisement is placed in the correct category;
  • the stated price, location, condition, availability, and other material details are not deliberately misleading;
  • photographs and other content accurately represent the advertised item or service;
  • you will update or remove the advertisement when it is no longer available;
  • you will not post duplicate advertisements unless expressly permitted;
  • you will not manipulate search results, rankings, views, or engagement;
  • you will not impersonate another individual or organization; and
  • you will comply with all applicable laws and licensing requirements.

We may reject, modify, limit, or remove an advertisement that violates these Terms or applicable law.

5. Prohibited Advertisements and Activities

You must not use the Platform to advertise, offer, request, promote, or facilitate illegal or prohibited goods, services, activities, or transactions.

Unless expressly permitted by applicable law and by us, prohibited content includes:

  • stolen property;
  • counterfeit goods;
  • fraudulent or deceptive offers;
  • illegal drugs or controlled substances;
  • illegal weapons, explosives, or prohibited weapons-related goods;
  • goods or services whose sale or distribution is prohibited by law;
  • forged documents or identification;
  • fraudulent financial schemes;
  • money laundering or other financial crimes;
  • phishing or identity-theft schemes;
  • hacking or malicious software;
  • advertisements intended to facilitate criminal activity;
  • sexual exploitation or exploitation of minors;
  • content involving child sexual abuse or exploitation;
  • discriminatory or unlawful employment advertisements;
  • advertisements that materially misrepresent qualifications, compensation, employment conditions, or job opportunities;
  • unlawful housing or rental discrimination;
  • advertisements for businesses or professional services that require a licence where the advertiser does not have the required authorization;
  • pyramid schemes or unlawful investment schemes;
  • misleading health, medical, financial, employment, immigration, or legal claims;
  • spam or mass unsolicited advertising; and
  • any other goods, services, content, or activities that we reasonably determine should not be offered through the Platform.

We may publish additional prohibited-item rules for particular categories.

6. Accuracy and Responsibility for Advertisements

The person who publishes an advertisement is solely responsible for its content.

We do not independently verify every statement, photograph, price, ownership claim, qualification, licence, employment offer, rental claim, or other representation made by an advertiser.

An advertisement appearing on the Platform does not mean that we have verified or endorsed the advertiser or the advertised goods or services.

Users should conduct their own reasonable checks before entering into a transaction.

7. Buying and Selling Between Users

Transactions are generally conducted directly between users.

Users are responsible for agreeing upon:

  • price;
  • payment method;
  • delivery or collection;
  • inspection;
  • warranties;
  • returns;
  • cancellation;
  • ownership or title;
  • applicable taxes and charges; and
  • any other transaction terms.

Unless we expressly provide a transaction or payment service, we do not receive, hold, or transfer the purchase price on behalf of buyers or sellers.

We do not guarantee that:

  • a seller owns the advertised item;
  • an item exists;
  • an item is genuine or authentic;
  • an item is safe;
  • an item is legal to sell;
  • an item corresponds to its description;
  • a buyer will pay;
  • a seller will deliver;
  • a service will be performed satisfactorily; or
  • a transaction will be completed.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded under applicable law.

8. Payments

Where the Platform offers paid advertising, subscriptions, promotions, verification services, or other paid features, the applicable price will be displayed before payment.

You agree to pay all applicable fees.

Unless otherwise stated:

  • fees must be paid using the payment methods we make available;
  • fees may be subject to applicable taxes;
  • paid advertising does not guarantee that an advertisement will result in a sale, hire, rental, or other transaction; and
  • we may change our fees prospectively by providing reasonable notice.

If a payment is reversed, disputed, cancelled, or otherwise not successfully completed, we may suspend the relevant paid service.

Any refund will be handled according to our applicable refund policy and mandatory legal requirements.

9. Employment and Job Advertisements

Users posting job advertisements are responsible for ensuring that their advertisements and recruitment practices comply with applicable employment laws.

Employers and recruiters must provide truthful information concerning:

  • the employer or recruiting organization;
  • job responsibilities;
  • qualifications;
  • location;
  • compensation where required;
  • working arrangements; and
  • other material employment conditions.

Advertisements must not be discriminatory, fraudulent, or designed to obtain money or personal information from job seekers through deception.

The Platform does not employ candidates merely because they respond to a job advertisement.

We do not guarantee that a job advertisement represents a genuine vacancy, and users should independently verify employers and employment opportunities before providing sensitive information or making payments.

The Platform should not be used to require job seekers to pay unlawful recruitment fees or to participate in fraudulent recruitment schemes.

10. Property and Rental Advertisements

Users posting rental advertisements must have the legal authority to advertise the property or rental item.

Rental advertisements should accurately state material information such as:

  • location;
  • rental amount;
  • deposit or other charges;
  • availability;
  • relevant conditions;
  • property or item description; and
  • important restrictions or requirements.

Landlords, tenants, property owners, agents, and renters remain responsible for complying with applicable laws and for their agreements with one another.

We are not a party to a lease, tenancy agreement, rental agreement, property-management agreement, or other arrangement between users unless expressly stated otherwise.

**Users should inspect property or rental items and verify ownership or authority before paying deposits or signing agreements.

11. Services

Service providers are responsible for ensuring that:

  • they are legally entitled to provide the advertised service;
  • they hold required licences or qualifications;
  • their advertisements accurately describe their services;
  • their prices and material conditions are not misleading; and
  • their services comply with applicable laws and professional requirements.

The Platform does not guarantee the quality, safety, legality, qualifications, availability, or results of services advertised by users.

12. User Communications

The Platform may allow users to communicate through messaging, contact forms, comments, or other communication tools.

You agree not to use these tools to:

  • harass, threaten, abuse, or intimidate another person;
  • send spam;
  • distribute malware;
  • solicit unlawful transactions;
  • collect personal information for fraudulent purposes;
  • impersonate another person;
  • send sexually exploitative or unlawful material; or
  • otherwise violate these Terms or applicable law.

Users should exercise caution when communicating with people they do not know.

13. Fraud and Scam Prevention

We encourage users to take reasonable precautions when using the Platform.

You should be cautious of requests involving:

  • advance payments without reasonable verification;
  • unusual payment methods;
  • requests for passwords or verification codes;
  • requests for banking credentials;
  • fake payment confirmations;
  • suspicious links;
  • offers that appear significantly below or above market value;
  • pressure to complete a transaction immediately;
  • requests to move a conversation outside the Platform for suspicious reasons; or
  • requests to send money before inspecting an item or property.

If something appears suspicious, do not proceed with the transaction and report the advertisement to us.

We may investigate reported advertisements and take appropriate action.

14. Reporting Advertisements

Users may report advertisements or accounts that they believe violate these Terms or applicable law.

A report does not guarantee that we will remove content.

We may review reported content and, at our discretion and subject to applicable law, remove, restrict, modify, or leave the content available.

We may also request additional information from the person who reported the content or from the advertiser.

15. Content You Upload

You retain ownership of content that you lawfully upload to the Platform.

However, by uploading photographs, descriptions, logos, videos, trademarks, text, or other material, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, adapt, distribute, and promote that content as reasonably necessary to operate, improve, market, and provide the Platform.

You represent that:

  • you own or have the necessary rights to the content;
  • the content does not infringe another person’s intellectual-property rights;
  • the content does not unlawfully disclose another person’s private information; and
  • your use of the content on the Platform complies with applicable law.

We may remove content where we reasonably believe it violates these Terms, applicable law, or another person’s rights.

16. Intellectual Property

The Platform, including its software, design, branding, logos, trademarks, graphics, text, functionality, and other original materials, belongs to us or our licensors and is protected by applicable intellectual-property laws.

You may use the Platform only for its intended purpose.

You must not, without our written permission:

  • copy or reproduce the Platform;
  • reverse engineer or attempt to extract source code, except where legally permitted;
  • scrape or systematically collect Platform data;
  • reproduce our branding;
  • interfere with Platform operation;
  • create competing services using substantial portions of our Platform or data; or
  • use automated systems to access the Platform in a manner that we have not authorized.

17. Privacy and Personal Information

Your use of the Platform may involve the collection and processing of personal information.

Our processing of personal information is described in our Privacy Policy, which forms part of these Terms.

Users must not collect, use, disclose, sell, or misuse another user’s personal information obtained through the Platform except as legally permitted and reasonably necessary for a legitimate transaction.

You should not publish another person’s sensitive personal information without authorization or a lawful basis.

Because electronic communications and online transactions may involve security risks, users should exercise care when sharing identity documents, financial information, passwords, or other sensitive information.

18. Electronic Communications

By using the Platform, you consent to receiving electronic communications relating to your account, advertisements, transactions, security, customer support, and Platform services where permitted by law.

Electronic records and communications may be used to document transactions and interactions with the Platform.

Where applicable, electronic contracts, records, communications, and signatures may have legal effect in accordance with applicable Cameroonian law.

19. Platform Availability

We will make reasonable efforts to keep the Platform available and functioning, but we do not guarantee that it will always be:

  • available;
  • uninterrupted;
  • error-free;
  • secure against every possible threat; or
  • free of defects.

The Platform may occasionally be unavailable because of maintenance, technical problems, security incidents, telecommunications failures, or circumstances beyond our reasonable control.

20. Suspension and Termination

We may suspend, restrict, or terminate an account or advertisement where we reasonably believe that:

  • these Terms have been violated;
  • applicable law has been violated;
  • the account is involved in fraud or abuse;
  • the account creates a security risk;
  • the information provided is false or misleading;
  • the Platform is being misused; or
  • action is necessary to protect users, the Platform, or third parties.

Where appropriate, we may provide notice and an opportunity to resolve the issue.

We may also terminate or discontinue all or part of the Platform in accordance with applicable law.

Termination does not automatically eliminate obligations or liabilities that arose before termination.

21. Disclaimers

To the maximum extent permitted by applicable law, the Platform is provided on an “as available” basis.

We do not guarantee the accuracy, reliability, completeness, legality, safety, quality, or availability of user-generated advertisements.

We are not responsible for the conduct of users or for disputes between users.

We do not guarantee that users will successfully buy, sell, rent, hire, be hired, or obtain services through the Platform.

Nothing in these Terms is intended to exclude or limit a statutory right, consumer protection, or other legal protection that cannot lawfully be excluded.

22. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be responsible for losses arising solely from:

  • transactions between users;
  • inaccurate or fraudulent advertisements posted by users;
  • failure of a buyer or seller to perform;
  • loss or damage to goods exchanged between users;
  • rental disputes;
  • employment disputes;
  • service-provider disputes;
  • unauthorized conduct by third parties;
  • interruption of telecommunications or Internet services; or
  • content supplied by users.

Where our liability cannot legally be excluded, it will be limited to the extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

23. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, costs, and reasonable expenses arising from:

  • your violation of these Terms;
  • your unlawful use of the Platform;
  • your advertisement or user content;
  • your transaction or dispute with another user;
  • your infringement of another person’s intellectual-property or other rights; or
  • your fraudulent, negligent, or unlawful conduct.

This provision does not require you to indemnify us to the extent that the relevant loss was caused by our own unlawful conduct or where such an obligation is prohibited by applicable law.

24. Changes to These Terms

We may update these Terms from time to time to reflect:

  • changes to the Platform;
  • new features or services;
  • changes in applicable law;
  • security requirements;
  • business changes; or
  • improvements to our policies.

We will post the updated Terms on the Platform and, where legally required or reasonably appropriate, provide additional notice.

Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by law.

25. Complaints and Customer Support

If you have a complaint about the Platform, an advertisement, an account, or another user, please contact us at our contact email address.

Please provide sufficient information for us to understand and investigate your complaint.

We may request supporting documents or additional information.

26. Dispute Resolution

We encourage users to first attempt to resolve disputes informally and in good faith.

If a dispute cannot be resolved informally, it will be handled in accordance with the applicable laws and competent courts or dispute-resolution mechanisms of the Republic of Cameroon, subject to any mandatory legal requirements.

Where applicable, matters governed by OHADA law shall be handled in accordance with the applicable OHADA legal framework.

Nothing in this section prevents a person from exercising a mandatory right or remedy available under applicable law.

27. Governing Law

These Terms are governed by the laws applicable in the Republic of Cameroon, without prejudice to mandatory provisions of applicable law.

Where applicable, OHADA Uniform Acts and other applicable regional legal instruments shall apply to matters within their scope.

28. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.

The remaining provisions will continue in effect.

29. No Waiver

Our failure to enforce a provision of these Terms does not constitute a waiver of our right to enforce that provision later.

30. Entire Agreement

These Terms, together with the Privacy Policy, Prohibited Items and Content Policy, Refund Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and us regarding your use of the Platform.

31. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent, except where permitted by law.

We may transfer or assign our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or similar corporate transaction, subject to applicable law.

ACCEPTANCE

By creating an account, posting an advertisement, contacting an advertiser, purchasing a paid Platform service, or otherwise using SELLFAST, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
