Welcome to SELLFAST Classified Listing Market Place (the “Platform,” “Website,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of SELLFAST including our website, mobile applications, messaging features, listing services, and related services (collectively, the “Services”).
By creating an account, posting an advertisement, browsing listings, sending messages, contacting another user, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.
These Terms are intended to apply to a classified-ads marketplace operating in Cameroon and should be read together with our Privacy Policy and any additional rules or policies published on the Platform.
1. ABOUT THE PLATFORM
SELLFAST is an online classified-ads platform that allows users to:
- publish advertisements and listings;
- browse advertisements;
- contact and communicate with other users;
- negotiate with other users; and
- arrange transactions directly with other users.
The Platform may include listings for vehicles, real estate and property, employment opportunities, goods, services, and other permitted categories.
We are generally not the seller, buyer, employer, employee, landlord, tenant, agent, broker, manufacturer, or service provider involved in a transaction between users.
Unless expressly stated otherwise, transactions are concluded directly between users. We do not take ownership of listed goods and do not guarantee that a transaction will occur.
2. ELIGIBILITY
You must be legally capable of entering into a binding agreement to use the Services.
You must provide accurate information when creating an account and must keep your account information reasonably current.
If you are under the legal age required to independently enter into the relevant transaction under applicable law, you may only use the Services with the involvement and consent of a parent or legal guardian where legally permitted.
We may refuse registration or restrict access where we reasonably believe that a person is not eligible to use the Platform.
3. ACCOUNT REGISTRATION AND SECURITY
Some features may require you to create an account.
You agree to:
- provide truthful and accurate registration information;
- maintain the confidentiality of your password and login credentials;
- not share your account with another person unless expressly permitted;
- promptly notify us of unauthorized access to your account; and
- remain responsible for activity conducted through your account, except to the extent caused by our own failure to maintain reasonable security.
You must not create an account using another person’s identity or impersonate another person, business, organization, or public authority.
We may require additional verification for certain accounts, listings, categories, or transactions.
4. LISTINGS AND USER CONTENT
Users may submit advertisements, photographs, videos, descriptions, prices, contact information, messages, reviews, and other materials (“User Content”).
By submitting User Content, you represent and warrant that:
- you have the necessary rights and authority to publish it;
- the information is accurate and not materially misleading;
- you are legally entitled to sell, rent, offer, advertise, or otherwise deal with the relevant item, property, service, or opportunity;
- the listing complies with applicable law;
- the listing does not infringe another person’s intellectual-property, privacy, contractual, or other legal rights; and
- the listing does not contain fraudulent, deceptive, defamatory, abusive, or unlawful material.
You are solely responsible for the accuracy and legality of your listings.
5. PROHIBITED LISTINGS AND ACTIVITIES
You may not use the Platform to advertise, offer, sell, purchase, promote, or facilitate any item, service, activity, or transaction that is illegal or prohibited by these Terms.
Prohibited content and activities include, without limitation:
A. Fraud and deception
- fake or fictitious listings;
- false identities;
- misleading prices or descriptions;
- counterfeit documents;
- advance-fee scams;
- phishing or impersonation scams;
- fraudulent payment requests;
- stolen goods;
- fraudulent investment or financial schemes; and
- attempts to obtain another person’s account, financial, or personal information.
B. Illegal goods and services
You may not list goods or services whose sale, possession, distribution, or provision is prohibited by applicable law.
This includes illegal drugs, prohibited weapons, stolen property, fraudulent documents, and other unlawful goods or services.
C. Dangerous or regulated goods
Listings involving regulated, hazardous, or restricted goods must comply with all applicable legal requirements. We may prohibit particular categories even where a transaction might otherwise be lawful.
D. Adult and exploitative content
You may not use the Platform for:
- sexual exploitation;
- child sexual abuse or exploitation;
- trafficking in persons;
- prostitution or sexual services where prohibited by law;
- sexually exploitative material; or
- content involving the exploitation or abuse of minors.
E. Intellectual-property violations
You may not upload or advertise counterfeit products or content that infringes another person’s copyright, trademark, patent, trade secret, or other intellectual-property rights.
F. Abuse of the Platform
You may not:
- send spam or unsolicited bulk messages;
- manipulate listings or search results;
- create multiple accounts for abusive purposes;
- scrape or systematically collect Platform data without permission;
- introduce malware, viruses, or malicious code;
- interfere with the operation or security of the Platform;
- attempt to gain unauthorized access to accounts or systems;
- use bots or automated tools in a manner that harms the Platform; or
- circumvent restrictions imposed on your account.
6. VEHICLE LISTINGS
Users listing vehicles must provide accurate information to the best of their knowledge, including, where applicable:
- make and model;
- year;
- mileage;
- registration information;
- ownership status;
- condition;
- known material defects;
- accident or damage history where required or known;
- asking price; and
- relevant documentation.
You must not advertise a vehicle that you do not have the legal authority to sell.
You must not alter, falsify, conceal, or misrepresent vehicle identification numbers, registration documents, ownership documents, mileage, or other material information.
Buyers are responsible for independently verifying ownership, documentation, mechanical condition, registration status, and any applicable taxes or fees before purchasing a vehicle.
7. PROPERTY AND REAL-ESTATE LISTINGS
Users advertising property must have the legal authority to advertise the property or have authorization from the owner or lawful representative.
Listings should accurately describe, where applicable:
- location;
- property type;
- size;
- ownership or rental status;
- asking price or rent;
- relevant conditions;
- availability; and
- material limitations or restrictions.
We do not independently verify ownership, title, boundaries, permits, zoning, construction status, rental rights, or other legal characteristics of a property unless expressly stated.
Users should conduct appropriate legal and physical due diligence before entering a property transaction.
8. JOB AND EMPLOYMENT LISTINGS
Employers and recruiters must ensure that job advertisements comply with applicable employment and anti-discrimination laws.
Job listings must accurately identify:
- the employer or recruiting entity, where required;
- the position;
- principal duties;
- relevant qualifications;
- location or work arrangement;
- compensation information where required or represented; and
- material conditions of employment.
Users must not use the Platform for fraudulent recruitment, identity theft, trafficking, employment scams, or requests for unlawful fees or payments from job applicants.
We do not guarantee that a job advertisement is genuine, that an employer will hire an applicant, or that an applicant is qualified or suitable.
9. TRANSACTIONS BETWEEN USERS
The Platform may allow users to communicate and arrange transactions with one another.
Unless expressly stated otherwise:
we are not a party to transactions between users.
Users are responsible for:
- negotiating transaction terms;
- verifying the identity and authority of the other party;
- inspecting goods or property;
- verifying ownership and documentation;
- determining applicable taxes and fees;
- selecting an appropriate payment method;
- arranging delivery or collection;
- complying with applicable laws; and
- resolving disputes arising from their transaction.
We strongly recommend that users exercise caution when dealing with people they have not previously met.
We do not guarantee the quality, safety, legality, authenticity, availability, ownership, condition, value, or suitability of any item, property, job, service, or opportunity advertised on the Platform.
10. PAYMENTS
Unless specifically identified as a payment or transaction service provided by [WEBSITE NAME], we do not process or guarantee payments between users.
Users should independently evaluate the safety and legitimacy of proposed payment methods.
We are not responsible for losses resulting from:
- fraudulent payments;
- unauthorized transfers;
- fake payment confirmations;
- chargebacks;
- mobile-money fraud;
- bank-transfer fraud;
- cash transactions; or
- payments made directly to another user.
Where we provide paid Platform services, such as promoted listings, subscriptions, advertising packages, or other premium features, additional pricing and payment terms may apply.
11. SAFETY AND OFF-PLATFORM MEETINGS
Users should exercise reasonable caution when meeting another user.
Where practical, we recommend:
- meeting in a public place;
- informing someone you trust about the meeting;
- inspecting goods before paying;
- verifying identity and ownership documents;
- avoiding unnecessary disclosure of personal information; and
- refusing suspicious or unusually urgent payment requests.
Never assume that a user is trustworthy merely because they have an account on the Platform.
12. REPORTING SUSPICIOUS CONTENT
If you believe that a listing, account, message, or transaction may involve fraud, illegal activity, abuse, or a violation of these Terms, you should report it to us using the reporting tools or contact information provided on the Platform.
We may investigate reports and take appropriate action, including removing content, restricting accounts, or cooperating with competent authorities where legally required or permitted.
We do not guarantee that every report will result in removal or other action.
13. CONTENT MODERATION
We reserve the right, but do not assume an obligation, to review, moderate, restrict, disable, or remove User Content or accounts where we reasonably believe that:
- these Terms have been violated;
- applicable law has been violated;
- the content is fraudulent, misleading, unsafe, or harmful;
- the Platform or its users may be exposed to legal, security, or reputational risk;
- the content interferes with the operation of the Platform; or
- action is reasonably necessary to protect users, third parties, or the Platform.
We may also cooperate with law-enforcement authorities and other competent authorities where required by applicable law or lawful process.
14. ACCOUNT SUSPENSION AND TERMINATION
We may suspend, restrict, or terminate your account or access to some or all Services if:
- you violate these Terms;
- you engage in fraudulent or abusive conduct;
- you provide false information;
- your account creates a security or legal risk;
- you repeatedly publish prohibited content;
- you misuse the messaging system;
- you fail to pay applicable Platform fees; or
- we are required to do so by law or a competent authority.
Where reasonably appropriate, we may provide notice and an opportunity to remedy the violation before taking action. However, immediate action may be taken where necessary to protect users, the Platform, or third parties.
15. USER CONTENT LICENSE
You retain ownership of User Content that you lawfully own.
By submitting User Content to the Platform, you grant SELLFAST a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and communicate that content as reasonably necessary to operate, promote, maintain, and improve the Services.
This license continues for as long as reasonably necessary for these purposes and may continue in backup systems or where retention is required by law.
You represent that you have the rights necessary to grant this license.
16. INTELLECTUAL PROPERTY
The Platform and its original content, software, design, branding, logos, graphics, text, databases, and other materials are owned by or licensed to SELLFAST and are protected by applicable intellectual-property laws.
Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit the Platform or its proprietary content.
Nothing in these Terms transfers ownership of our intellectual property to you.
17. PRIVACY AND PERSONAL DATA
Your use of the Platform involves the processing of personal information.
We will process personal data in accordance with applicable Cameroon law and our Privacy Policy.
Cameroon adopted Law No. 2024/017 of 23 December 2024 on the protection of personal data, which establishes a dedicated legal framework governing the processing of personal data.
Our Privacy Policy explains, among other things:
- what personal information we collect;
- why we collect it;
- how we use and protect it;
- when information may be shared;
- how long information may be retained; and
- how users may exercise applicable privacy rights.
You should not publish another person’s personal information without a lawful basis or authorization.
18. ELECTRONIC COMMUNICATIONS AND MESSAGES
The Platform may provide messaging tools that allow users to communicate.
You are responsible for the messages you send and must not use messaging features for harassment, threats, fraud, spam, unlawful solicitation, or other prohibited conduct.
Messages and related information may be processed, retained, or reviewed where reasonably necessary to operate and secure the Platform, investigate abuse, enforce these Terms, or comply with applicable law, subject to our Privacy Policy and applicable data-protection requirements.
19. THIRD-PARTY SERVICES AND LINKS
The Platform may contain links to third-party websites, payment services, mapping services, advertising providers, or other services.
Third-party services are governed by their own terms and policies.
We are not responsible for the content, availability, security, privacy practices, or performance of third-party services.
20. NO WARRANTIES
To the maximum extent permitted by applicable law, the Services are provided on an “as available” and “as is” basis.
We do not guarantee that:
- the Platform will always be available;
- listings will remain online or unchanged;
- information provided by users is accurate;
- users are who they claim to be;
- listings are genuine;
- transactions will be completed;
- goods or property are safe, legal, authentic, or fit for purpose;
- employers or job applicants will fulfill their obligations; or
- the Platform will be free from errors, interruptions, malware, or security vulnerabilities.
Nothing in these Terms excludes or limits any consumer protection, statutory warranty, or other legal right that cannot lawfully be excluded or limited under applicable law.
21. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, SELLFAST ,its owners, directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from or relating to:
- use of or inability to use the Platform;
- transactions between users;
- fraud or misconduct by another user;
- inaccurate or misleading listings;
- loss of money, property, business, profits, data, or opportunities;
- disputes between users;
- reliance on information appearing on the Platform; or
- unauthorized access caused by circumstances outside our reasonable control.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
22. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless SELLFAST its owners, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising out of:
- your violation of these Terms;
- your User Content;
- your unlawful conduct;
- your violation of another person’s rights; or
- a transaction or dispute involving you and another user.
This provision does not require you to indemnify us for losses caused by our own unlawful conduct or liability that cannot legally be transferred to you.
23. CHANGES TO THE SERVICES
We may modify, suspend, discontinue, or restrict any part of the Services at any time.
We may also introduce new features or remove existing features.
Where required by law, we will provide appropriate notice of material changes.
24. CHANGES TO THESE TERMS
We may update these Terms from time to time.
When we make material changes, we may notify users through the Platform, email, or another reasonable method.
The updated Terms will become effective on the date specified in the updated Terms.
Your continued use of the Services after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.
25. GOVERNING LAW
These Terms are governed by and interpreted in accordance with the laws of the Republic of Cameroon, subject to any mandatory provisions of applicable law that cannot be excluded by contract.
Where applicable, relevant OHADA rules and other mandatory regional or national legal provisions shall also apply.
26. DISPUTE RESOLUTION
If you have a dispute with SELLFAST you agree to first contact us and attempt to resolve the matter amicably.
If the dispute cannot be resolved amicably, it may be submitted to the competent courts of Cameroon, subject to mandatory jurisdictional rules and any rights that consumers may have under applicable law.
Nothing in this section prevents a party from seeking urgent interim or protective relief from a competent court where appropriate.
27. CONSUMER RIGHTS
Nothing in these Terms is intended to deprive consumers of rights or protections that cannot legally be waived under applicable Cameroon law.
Where a provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement will prevail to the extent of the conflict.
28. FORCE MAJEURE
We will not be responsible for delays, interruptions, or failures caused by events beyond our reasonable control, including natural disasters, war, civil unrest, government action, telecommunications failures, internet outages, cyberattacks, power failures, strikes, or failures of third-party infrastructure.
29. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
30. NO WAIVER
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.
31. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies expressly incorporated into them, constitute the agreement between you and [WEBSITE NAME] concerning your use of the Services.
They replace any prior agreements or understandings concerning the same subject matter, except where otherwise expressly stated.
32. ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where permitted by law.
We may transfer or assign our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or similar transaction, subject to applicable law.
